The question of compensation for employees who separate by mutual agreement from their employer is on the agenda for discussions in the National Assembly as part of the budget for this Wednesday, November 5. The government denounces the cost as being too high and wants to increase the contribution from businesses.

Christophe was a carpenter, Nathalie a saleswoman. Both were able to benefit from a conventional termination, an agreement with their employer to amicably terminate their CDI (permanent contract, editor’s note) and benefit from unemployment benefits. “It helped us to have free time, especially to set up this business and also to have ASSEDIC”he explains.

Like them, nearly 515,000 of them will benefit from it in 2024, a number that has been increasing since 17 years and the creation of the system. But this comes at a cost: 10 billion euros in unemployment compensation per year, according to the government. They propose to increase the employer contribution rate for conventional terminations by 30 to 40%, but reversing this procedure could have other consequences. “If it is the employee who was rather requesting a conventional termination and who was refused, we can imagine that the psychosocial risks increase in the company. That is to say that we will have an employee who will no longer be in his place in the company, who will no longer want to come”observes Delphine Cuenot, labor law lawyer.

Risks also highlighted in a note published yesterday by the Public Policy Institute. According to the authors, the total number of resignations decreased by 19% after the introduction of the system
